德国刑法教科书通过真实的判例来解释刑法规范的含义,既是一种教科书写作风格,也体现出通过判例对刑法进行学理解释的方法魅力。通过判例解释刑法的学理解释方法,在问题意识和法律思维培养方面具有鲜明的特点。随着我国指导性案例数量的增长,设想将指导性案例引入学理解释,引入刑法教科书,实现司法和学理之间的良性互动,以推动法官裁判水平和学者的研究水平的共同提升。
German criminal law textbook through the real case to explain the meaning of the criminal law norms, both a textbook writing style, but also reflects the legal interpretation of the criminal law through case law charm. Explaining the method of interpretation of the theory of criminal law by means of case law has distinct characteristics in cultivating the problem awareness and legal thinking. With the increase of the number of guiding cases in our country, it is envisaged to introduce the guiding case into the explanation of theories, to introduce the textbook of criminal law to realize the benign interaction between justice and theory so as to promote the joint promotion of judges ’ruling level and scholars’ research level.
