一、工会组织在签订集体合同过程中的代表、维护作用代表作用。集体合同是一种特殊的劳动合同,其特殊性在于其当事人的特定性。《工会法》第18条第2款规定,工会可以代表职工与企业、事业单位行政方面签订集体合同。《劳动法》第33条规定,集体合同由工会代表职工与企业签订,没有建立工会的企业由职工推举的代表与企业签订。集体合同的当事人不是任意的劳动法律关系主体,不是随便一个人或组织就能签订的作为职工一方代表参与集体合同法
