近日出台的关于《物权法》第六章的两个司法解释(《建筑物区分所有权司法解释》和《物业服务纠纷司法解释》)是关系到全国亿万业主根本权利的司法解释,是在《物权法》实施过程中,针对实践过程中存在的一些问题集中做出的具体规定细则,是对《物权法》在理论上和实践上的发展和延伸。这两个司法解释的制定和具体应用,关系到我们如何将这部亲民的法律落到实处的问题,所以对这两个解释的正确理解就显得非常重要,关系到处理业主之间、业主与物业服务公司之间、业主与开发商及相关组织之间的权利与义务的关系。本文就是从这两部司法解释对司法实践和人民生活的重要影响入手,对其进行系统详尽的评述,以明确司法实践对这两个解释的正确理解适用的作用。 The two judicial interpretations (“Judicial Interpretations of Building Diversified Ownership” and “Judicial Interpretations of Property Servicing Disputes”) issued recently on Chapter 6 of the Real Right Law are the judicial interpretations concerning the fundamental rights of millions of homeowners in the country. "In the process of implementation, the specific rules and regulations made in light of some problems existing in practice are the theoretical and practical development and extension of the Real Right Law. The formulation and specific application of these two judicial interpretations are related to the question of how we can bring this pro-people law into practice. Therefore, a proper understanding of these two interpretations is very important and concerns the handling of disputes between owners, Property Services Companies, Owners and Developers, and Related Organizations, Rights and Obligations. This article starts with the important influence of these two judicial interpretations on judicial practice and people's life, and gives a detailed and systematic review of these two judicial interpretations to clarify the role that judicial practice can play in the correct understanding of these two interpretations.
