商主体设立登记过程中,世界各国(地区)关于登记生效时间没有统一的规定,通过对登记注册、执照签发、登记公告三个程序性质及功能的分析,可以发现商主体设立登记生效之日应为其登记注册于登记簿之日。本文指出明确注册登记作为商主体成立的基础条件,对于解决我国现实登记制度发展过程中出现的问题以及未来进行商事登记立法都有着极为重要的意义。
During the process of registering business entities, there is no uniform regulation on the effective time of registrations in all countries (regions) in the world.
