价值是人类社会共同追求的行为目标,是主观见之于客观的产物,是人们活动的目的和方向。刑事诉讼活动贯穿着深厚的价值底蕴。“法的价值就是法这个客体(制度化的对象)对满足个人、群体、社会或国家需要的积极意义。”刑事诉讼法的价值是标志该法与人的相互关系的一个范畴,是从当代中国社会、中国人的需要出发去评价该法在调整刑事诉讼关系时对人的意义和作用,是通过法律规定肯定某种诉讼关系的精神内涵。
Value is the goal pursued jointly by human society. It is the objective product of subjectivity and the objective and direction of people’s activities. Criminal proceedings run through a deep value of heritage. “The value of law is the positive meaning of the object of law (the object of institutionalization) in satisfying the needs of individuals, groups, societies or nations.” The value of the Code of Criminal Procedure is a category that marks the interrelationship between the law and human beings, Chinese society and Chinese need to evaluate the significance and role of this law in regulating the relationship between criminal proceedings and affirm the spiritual connotation of certain litigation relationship through the law.
