审判委员会(以下简称审委会)是人民法院决定案件处理的最高审判组织,是审判业务方面的决策机构,指导和监督全院审判工作。其存在有着历史和政治、经济的原因,具有必然性和合理性。它作为审判工作的一个集体领导机构,在讨论、决定重大、疑难案件,总结审判经验和其他有关审判工作方面发挥了一定的作用。然而通过重新审视审委会,发现其存在一些弊端,亟需以改革的方式予以解决。
The Trial Committee (hereinafter referred to as the “Trial Committee”) is the supreme judicial organization that the people’s court decides to handle the case and is the decision-making organ for the trial of business. It guides and supervises the entire trial. Its existence has historical and political, economic reasons, with inevitability and rationality. As a collective leadership agency in the adjudication process, it has played a role in discussing, deciding major and difficult cases, summarizing trial experience and other relevant trials. However, by re-examining the CRIC, some shortcomings have been found, and it is urgently needed to be solved by means of reform.
