美国的宪法案件,是基于美国的联邦最高法院对于宪法的解释权。我国2001年发生的齐玉岺案,被称为是我国宪法第一案。从那年开始我国掀起了对于宪法案件的讨论。随着社会经济的不断发展,公民法律意识的不断健全,人们对于保障宪法所规定的公民基本权利、限制国家权力的需求也不断提升,对宪法案件的讨论也在不断深入。本文通过对美国宪法案件以及我国有关宪法的案件梳理和比较,简单阐述宪法案件的特点及其发展状况。
The U.S. constitutional case is based on the power of the United States Supreme Court to interpret the Constitution. The case of Qi Yuelong in our country in 2001 is called the first case of our country’s constitution. Since then, China has started a discussion of constitutional cases. With the continuous development of social economy and the constant improvement of citizens’ legal awareness, people are constantly increasing their demand for guaranteeing the basic rights of citizens prescribed by the Constitution and restricting state power. Discussions on constitutional cases are also continuing to deepen. Through the combing and comparison of the cases of the U.S. constitution and the constitution of our country, this paper simply expounds the characteristics of the constitutional case and its development.
