随着我国社会主义经济制度的日益发展,现有的法律法规已经不能很好的规范经济市场及社会活动中的不良文明行为。我国的法制体系建设还不够完善,虽然有相关法律法规予以规范,但是社会中的违法现象还是屡禁不止。很多时候,法律运用起来很容易,但是在执行的时候却很困难。这就是法律实践过程中的“履行难”问题。随着社会经济的日益发展,新的违法犯罪行为也层出不穷,法律的规定已经跟不上犯罪分子的作案手法和步伐。根据我国法律在现代社会中的应用遇到的种种问题提出了解决的办法和新的法律应用的方法。
With the continuous development of the socialist economic system in our country, the existing laws and regulations have failed to regulate the bad civilized behaviors in economic markets and social activities well. The construction of the legal system in our country is still not perfect. Although there are relevant laws and regulations to regulate it, the phenomenon of illegal activities in the society is still repeated. In many cases, the law is easy to use, but difficult to enforce. This is the “difficult fulfillment” issue in the legal practice. With the increasing social and economic development, new criminal activities are also emerging one after another, and the provisions of the law have failed to keep pace with the criminals’ modus operandi. According to the problems encountered in the application of our law in modern society, we put forward solutions and new methods for the application of law.
