海外投资保险制度是指资本输出国对本国的海外投资者在国外可能遇到的政治风险,提供保险或保证的一种制度。我国越来越多的投资者走出国门,进行海外投资,在国外面临巨大的政治风险。而我国现有的海外投资保险制度仍难以适应现实的需要,我国应在充分考虑本国的经济发展和海外投资实际的基础上,借鉴美、日、德等国的有益立法经验,结合相关的国际公约,建立健全有中国特色的海外投资保险制度。
Overseas investment insurance system refers to the capital exporting countries for their overseas investors may encounter political risks abroad, a system of insurance or guarantee. More and more investors in our country go abroad and make overseas investments, facing huge political risks abroad. However, the current overseas investment insurance system in our country is still hard to adapt to the real needs. Based on the actual economic development and overseas investment of our country, our country should draw lessons from the beneficial legislative experiences of the United States, Japan and Germany, Convention, establish and improve the overseas investment insurance system with Chinese characteristics.
