我国是目前世界第一货物贸易大国和第三服务贸易大国。国际贸易必然需要用某种货币进行支付结算,在现有各主权货币中,选择用人民币对我国来讲无疑具有重要的意义。它不仅可以取得发行收入,还可以减少我国的汇率风险和外贸交易成本,提高我国在国际经济、政治活动中的地位,使我国在国际事务中具有同经济实力相适应的影响力,使国际经济、政治环境不断向着有利于我国的方向发展。人民币国际化既是一个经济问题,也是一个法律问题,它不仅涉及国际法,更重要的是需要对我国的相关国内法进行修改和完善。本笔谈的核心就是讨论人民币国际化的相关法律问题,这些问题概括起来主要包括:国际法中关于主权货币国际流通与争端解决的基本规则,在人民币国际化过程中应该对我国现行的现金法规、支付结算法规进行哪些修改和完善,应该构建哪些人民币国际化的纠纷解决制度,应对人民币跨境流通监管制度进行哪些修改和完善等。围绕着这些人民币国际化的核心法律问题,我们在完成国家社会科学基金重点课题“国际法视角下的人民币国际化问题研究”的过程中,将相关已有的研究成果进行了整理并提供给读者,以期能够促进我国学术界和实务界对人民币国际化法律问题的研究,并得到相关专家、学者的批评指正。
Our country is the world’s largest power trade country and the third largest trade in services. International trade will inevitably require payment and settlement in a certain currency. In the existing sovereign currencies, the choice of RMB is undoubtedly of great significance to our country. It can not only obtain distribution income, but also reduce our exchange rate risk and foreign trade transaction costs, enhance our country’s position in international economic and political activities, and make our country have an influence in international affairs that adapts to economic strength so that the international economy The political environment continues to develop in the direction of our country. The internationalization of RMB is not only an economic issue but also a legal issue. It not only involves international law but more importantly, it needs to revise and improve the relevant domestic laws in our country. The core of this writing is to discuss the legal issues related to the internationalization of RMB. These issues can be summed up as follows: The basic rules governing the international circulation and dispute settlement of sovereign currencies in international law should be paid to the current cash regulations in China during the process of RMB internationalization What changes and improvements should be made to the settlement regulations, what are the international dispute resolution systems that should be constructed in RMB, and what changes and improvements should be made in the regulation of RMB cross-border circulation. Around the core legal issues of RMB internationalization, in the process of completing the key project of the National Social Science Fund, “Research on RMB Internationalization under the Perspective of International Law”, we have sorted and provided relevant research results Readers, with a view to promoting our academic and practical circles on the legal issues of RMB internationalization, and get the relevant experts and scholars criticism and correction.
