国务院修订后的《信访条例》颁布实施至今已近十年,在进一步畅通群众信访渠道,规范信访工作行为,提高信访工作效率等方面发挥了重要作用。但随着经济社会的发展和法治中国建设的推进,信访工作面临的形势和任务发生了很大的变化,《信访条例》已不适应当前信访工作实践的需要,迫切需要从更高层面对信访进行立法。本文以广东省人大颁布实施的《广东省信访条例》为例,对信访立法的必要性,立法的原则和立法过程中应当研究解决的问题,立法对信访治理特别是领导干部依法行政、信访人依法表达诉求的要求等问题进行了分析。
The State Council revised the “Petition Ordinance” promulgated and implemented nearly 10 years ago, in further easing the channels of letters and visits, standardize the petition work behavior, improve the efficiency of petition work has played an important role. However, with the development of economy and society and the progress of the rule of law in China, the situation and the tasks confronting the petition work have undergone tremendous changes. The petition regulations have not met the needs of current petitions and work practices. There is an urgent need for the petitions from a higher level Legislation. This article takes Guangdong Provincial People’s Congress promulgated and implemented the Regulations of Guangdong Province as an example to discuss the necessity of legislation on petitions, the principle of legislation and the problems that should be solved in the process of legislation. Legislation is of great importance to the handling of petitions by letters and visits, especially the law-based administration of leading cadres, According to the requirements of the expression of demands and other issues were analyzed.
