(接2014年第11期)雇员的职责与责任在劳动关系范围内,雇佣方有权在劳动合同中具体规定雇员的义务。这些规定可以通过岗位或职能的分配,以及单项工作任务的分派实现,前提是这些工作任务都是雇员在签署劳动合同时约定的工作范围。雇员需自愿签署劳动合同,表明自己同意接受这些工作任务及相关职责,包括由此产生的安全保障义务。除此之外,雇佣方还可以发布具体的单项指令。发布(单项)指令的权力依据Gew O第106条和德国《民法典》第315条,应包含执行地点、执行时间和工作内容。
(Continued 2014/11) Duties and Responsibilities of Employees Within the scope of labor relations, the employer has the right to specify the employee’s obligations in the employment contract. These provisions can be achieved through the allocation of positions or functions and the assignment of individual tasks as long as the tasks are agreed by the employee at the time of signing the employment contract. Employees are required to sign a labor contract on a voluntary basis, indicating that they agree to accept these tasks and responsibilities, including the resulting safety and security obligations. In addition, the employer can issue specific individual instructions. The power to issue the (individual) Directive shall be based on Article 106 of Gew O and Article 315 of the German Civil Code, including the place of execution, the time of execution and the content of the work.
