就业是民生之本,也是妇女赖以生存发展的基本经济资源。传统观念以及对妇女有害的传统文化和宗教习俗延绵不绝,导致对妇女的歧视长期存在。本文首先基于国际人权文件分析了不歧视原则的内涵;其次阐释了我国妇女平等就业权制度中适用该原则的现状及困境;最后从立法、执法、司法层面提出了完善该原则在妇女平等就业权保障制度体系中的适用建议。
Employment is the foundation of people’s livelihood and also the basic economic resource for women’s survival and development. Traditional beliefs, as well as traditional cultural and religious practices that are harmful to women, have led to the persistence of discrimination against women. This article first analyzes the connotation of the principle of non-discrimination on the basis of international human rights documents. Secondly, it expounds the status quo and predicament of applying this principle to the equal employment rights of women in China. At last, Applicable suggestion in system of guarantee system.
