2005年1月17日深圳市政府颁布了《深圳市业主大会和业主委员会指导规则》(以下简称《导则》,本专题文章同此),作为市政府规范性文件颁布施行,首次确定了三大变化:业主委员会主任要有深圳户籍(全部为非深圳户口的除外);业主委员会都归街道办管:业主委员会如有严重违规的行为主管部门有权责令解散。这些问题都涉及到业主委员会的行政主管部门所设定的行政权的管理。本文试从司法实践的角度谈谈个人观点。
January 17, 2005 The Shenzhen Municipal Government promulgated the Guidelines for the Guidance of Owners and Owners Committees of Shenzhen Municipality (hereinafter referred to as Guiding Principles), promulgated and implemented as the normative documents of the municipal government and identified for the first time three Major changes: the owners of the board of directors to have Shenzhen household registration (all non-Shenzhen accounts excluded); owner committees are governed by the street: the owners of committees if there is a serious breach of the competent authorities ordered to dissolve. These issues are related to the management of the administrative power set by the administrative department of the owners’ committee. This article tries to talk about personal point of view from the perspective of judicial practice.
