近些年来,个人信息被非法传播、泄露的事情屡见报端,前不久的3.15晚会再一次曝光多家商业银行工作人员贩卖客户个人信息、资料以获取不法利益。一时间关于个人信息权益是否属于个人,个人信息是否应该脱离个人控制而任意流转的讨论再一次引起社会关注。笔者拟从法经济学视角入手,分析个人信息利益归属与社会成本之间的关系。
