国际公共领域不仅仅是国内法框架下不受知识产权保护的思想与表达的总和,又基于各国的法律、政策、时间以及习惯所表现出来的差异,国际公共领域主要包括具有国际公共领域地位的、明确不属于任何国内法的专有权利范围的知识产品以及其他在任何国内法的法律框架下知识产权保护期限届满的知识产品,即使受到各国国内法有关使用方面的诸多规则的限制仍可以自由获得的知识领域以及更多地以一种积极意义上的管理人或集体义务的身份为特征或者以通过集体授权而加以使用和受益为特征的国际公共领域的概念。国际知识产权条约体系应当是在公共获得与私人利益之间相互作用的基础上确保国际公共产品的传播得以发挥最大效用,然而其从本质上便利甚至促进某些知识产品从国际公共领域转化成私权领域的政策的产生,甚至可能会超出其本身范围在有争议的政策基础上产生专有权利,但同时它又为国际公共领域的明确及维护提供了一个平台和基础。
