遗传资源及相关传统知识的获取与惠益分享制度是国际生物多样性保护与可持续利用的研究热点。《生物多样性公约》秘书处提供了一个惠益分享的蓝图,基于对此蓝图的理解与分析,本文提出了更具体的惠益分享路线图,尤其探讨了遗传资源或相关传统知识提供者的所有权理论问题,以及“事先知情同意”和“共同商定条件”等约定的核心内容。通过加深对于遗传资源、传统知识和提供者之间的整体性和互动性的理解,指出惠益分享的目标在于对此整体进行保护与可持续利用,从而为我国惠益分享制度设置提供了合理化建议。
