二元土地所有制是产生“小产权房”问题的制度根源,“小产权房”不符合我国现有集体建设用地的制度安排。从法经济学视角来看,法律活动要以资源的有效配置和合理利用为目的,大量“小产权房”的出现表明外部利润的存在。通过完善集体土地所有权制度、明确定位集体建设用地制度功能、健全集体建设用地流转机制等措施,可以将外部利润内在化,有效实现最大化经济效益,从而从根本上解决“小产权房”问题。
Binary land ownership is the source of the system of “small property room” issue, “small property room” does not accord with the institutional arrangement of the existing collective construction land in our country. From the perspective of law and economics, legal activities should aim at the effective allocation of resources and reasonable utilization. The appearance of a large number of “small property houses” indicates the existence of external profits. By perfecting the system of collective ownership of land, defining the function of collective construction land system and perfecting the circulation mechanism of collectively-owned construction land, internal profit can be internalized and maximized economic benefits can be realized effectively so as to fundamentally solve the problem of “small property room” problem.
