不纯正不作为犯的作为义务之判断是认定是否构成不纯正不作为犯的核心问题。确立实质的作为义务判断标准,是限定不纯正不作为犯处罚范围的关键。作为义务的实质来源判断标准应当从法益保护和社会功能关系两个角度加以限定。具体而言,即在特定的社会存在中,行为人基于特定的社会功能关系所要求的保护法益的要求,在排他性地控制了法益侵害结果的发生,或者事实上处于控制危险源的地位,能够防止结果的发生而不防止的场合,即可认定其具有作为义务。
