民事诉讼中证明责任分配原则以一般原则为主、证明责任倒置为辅,本文仅就我国民事诉讼中证明责任分配的一般原则略作剖析,联系实例着重分析民事诉讼法第64条的含义及其尚待改进之处,并归纳总结了部分关于完善民事诉讼中证明责任分配一般原则的意见和建议。
The principle of liability distribution in civil litigation is based on the general principle and the proof responsibility is inverted. This article only briefly analyzes the general principles of the burden of proof in civil litigation in our country.
