一、前言日本在1979年的最高判决首次认可动产让与担保之后,尤其是近十年内,出现了许多令人瞩目的判决,关于集合动产让与担保的诸多法律问题也日渐浮出水面。本文希望就集合动产让与担保相关案例之发展进行概说。在此之前,先看一下关于物的让与担保法的构成。二、让与担保法的构成案例虽然承认让与担保中所有权的转让,但由于担保的限度原因,在一定程度上限制其转让的效力。比如,1982年9月28日的最高判决记载:
