我国比较广告的立法起步较晚,随着市场经济的深入发展,已日益显露出其滞后性的缺陷。特别是新情况与现有广告法律的规定存在着相当大的偏差,已不能完全适应审判实践的需要。我国比较广告的最早立法是1987年10月26日国务院发布的《广告管理条例》,其第8条规定:“广告有下列内容之一的,不得刊播、设置、张贴:……贬低同类产品的。”国家工商局先后颁布了《化妆品广告管理办法》、《医疗广告管理办法》、《医疗器械广告审查标准》、《农药广告审查标准》、《兽药广告审查标准》、《药品广告审查标准》、《食品广告发布暂行规定》,规定了对药品、医疗器械、农药、兽药、保健食品、化妆
The legislation of comparative advertising in our country started relatively late. With the further development of market economy, the lagging defects have become increasingly apparent. In particular, there are considerable discrepancies between the new situation and the provisions of the existing advertising laws and can not completely meet the needs of trial practice. The earliest legislation on comparative advertising in our country was the “Regulations on Advertising Management” promulgated by the State Council on October 26, 1987.
