网络在给我们的日常生活带来极大改变的同时也向传统的法学理论不断提出新的课题,网络的无国界性使得知识产权诉讼的严格地域性原则受到严峻挑战。本文在分析欧美国家知识产权诉讼管辖权的理论与实践的基础上,探讨了在网络环境下我国有关涉外知识产权诉讼的管辖权原则。
The network has brought great changes to our daily life as well as constantly presenting new topics to the traditional jurisprudence theory. The borderless nature of the network poses a serious challenge to the strict geographical principle of intellectual property litigation. Based on the analysis of the theory and practice of the jurisdiction of intellectual property litigation in Europe and the United States, this paper discusses the principle of jurisdiction of our country in the litigation of foreign intellectual property under the network environment.
