我国经济的快速发展,必然伴随着城市化进程的加快,政府基于城市发展所带来的公共利益的需要,必然要征收原属于集体所有的、农民使用的集体土地,作为对价,政府补偿给集体和失地农民如土地补偿费、安置补助费、地上附着及青苗补偿费等相应的费用,但是现行的补偿标准过低,导致失地农民与政府之间的矛盾日益突出;通过对国内外土地征收制度的研究,在正确界定土地发展权的概念、厘清土地发展权的主体、对比国内外土地发展权制度的基础上,尝试引入土地发展权概念,提出构建我国合理的土地收益分配机制设想,从而切实保障农民的合法利益,维护农民的土地权益,保证城市化顺利推进。
