民愤影响定罪量刑是中国刑事司法的现实图景。民愤作为外在的监督力量能够促进司法的良性运作,我们应该正视民愤,杜绝打击、压制民愤,让民愤得到充分表达;但是,司法有其独有的运作规律,民愤与司法在案件的具体裁量上存在着种种冲突与矛盾,民愤不应干涉到个案的具体裁量。
Indignant Influence Conviction Sentencing is a realistic picture of China’s criminal justice. As an external supervisory force, anger can promote the healthy operation of the judiciary. We should face up to the anger of the people, eliminate blows and suppress public anger, and give full expression to popular anger. However, judiciary has its own unique operating rules. There are all kinds of conflicts and contradictions, and public indignation should not interfere with the specific discretion of individual cases.
