消费者不是知识产权诉讼当事人却普遍出现于司法裁判中,而且知识产权裁判中“消费者”的运用已经突破了消费者保护法对“消费者”概念的界定,在购买使用目的、主体类型划分、组织形态上均有拓展。消费者保护法与知识产权法对“消费者”的法律形塑差异产生了消费者概念的法律适用冲突。为了维护法制统一,要明确知识产权法中“消费者”的群体属性,以“相关公众”上位概念涵摄通常意义上“消费者”概念不能指称的范围,并在裁判中根据实际确定合适的相关公众范围。
