新《消费者权益保护法》(以下简称新《消法》)于2014年3月颁布并实施。自新《消法》第四十九条规定了3倍赔偿以后,出现了很多利用这一规定进行索赔的案件,且部分案件引起了广泛争议。这一大背景为一些职业打假人增添了新动力,促使他们在市场上充分发挥了其“应有的”作用,用其自己的话说就是“获利丰厚”。从中暴露出《消法》第四十九条规定的诸多不完善之处。本文暂不去探讨《消法》第49条存在关于欺诈性加倍赔偿的问题,只是对《广东省著名商标认定及管理规定》(以下简称《规定》)第二十条中所存在的瑕疵问题进行探讨。
