一、前言2013年由中国人民银行颁布试行的《中国人民银行金融消费权益保护工作管理办法》第4条规定的“本办法所称金融消费者,是指在中华人民共和国境内购买、使用金融机构销售的金融产品或接受金融机构提供的金融服务的自然人”是国内法源中首次定义“金融消费者”一词者。按其定义,“金融消费者”为自然人,不包含法人。唯衡诸2008年金融风暴与过去1999~2000年的网络泡沫或者2002年恩龙公司和世界通讯公司财报不实造成的资本市场动荡不同,过去几次造成损失的主要对象是零售投资人(俗称“散户”),本次受到损失的,不仅是零售投资人,包含一般法人,甚至金融机构均为重受
