改革开放30年以来,我国市场经济飞速发展,国民生产总值显著提高,这些都充分展示了社会主义市场经济制度的优越性。但随之而来产生的各类问题却层出不穷,社会财富不断集中于少数人手中,行政垄断加剧,市场规制不力等。在这样的大背景下,《反垄断法》呼之欲出,历经14年的研究讨论,终于在2008年8月1日起施行。本文重在于探讨反垄断法施行过程中的各类问题,提出意见和建议。
Since the reform and opening up to the outside world 30 years ago, the rapid development of China’s market economy and the remarkable increase in the gross national product have fully demonstrated the superiority of the socialist market economic system. However, the ensuing problems of various kinds have come forth endlessly. The social wealth has been continuously concentrated in the hands of a few people, the administrative monopoly has been aggravated, and the market regulation has been ineffective. Against this backdrop, the Anti-Monopoly Law is almost ready. After 14 years of research and discussion, it finally came into force on August 1, 2008. This article focuses on the various problems in the implementation of antitrust law and puts forward opinions and suggestions.
