言论自由作为公民权利中最重要的一项权利应受到人们的广泛重视,但目前我们关于言论自由的探讨由于理论和视野的不足以及传统思维模式的影响,我们的探讨广度和深度还有待进步。探析言论自由宪法边界的限制的相关理论,是从一个侧面讨论言论自由相关问题的一种新的尝试。本文首先从言论自由的意义和理论基础来论述言论自由的必要性;其次在论述关于自由边界的基本原则的前提下,从本人和其他人、言论和行动、公共秩序和私人利益三个维度分析影响言论自由宪法边界的因子;接着介绍规制言论自由宪法边界的具体原则和机制——即明显与即刻的危险原则、事前管制与事后管制、场所限制——三个方面的具体内容;然后总结规定言论自由宪法边界的方法——市场决定论的实用主义方法和利益衡量法。最后对于本文的言论自由宪法边界的问题做一小结,以及就此研究的意义和所展现出来的启示作一些理论的分析。
Freedom of speech as the most important right in civil rights deserves our attention. However, at present we have to explore the breadth and depth of our discussion on the freedom of speech due to the lack of theory and vision and the influence of traditional modes of thinking. It is a new attempt to discuss the issues related to the freedom of speech from a single perspective to analyze the limitations of the constitutional boundaries of free speech. This article first discusses the necessity of freedom of speech from the meaning and theoretical basis of freedom of speech. Secondly, on the premise of discussing the basic principle of free boundary, from the three dimensions of himself and others, speech and action, public order and private interests The factors that influence the boundaries of the constitutional freedom of speech; and then the specific principles and mechanisms for regulating the constitutional boundaries of freedom of expression - that is, the explicit and immediate principles of danger, ex ante control and ex post regulation, and the restrictions of places - and then summarize the provisions The Method of Free Speech on Constitutional Boundary - The Pragmatism and Measurement of Interests in Market Determinism. In the end, I make a summary of the issue of constitutional freedom of speech in this article, and make some theoretical analysis on the significance of the study and the revelation it shows.
