本文在简述了审理船舶碰撞案的两种方式(诉讼和仲裁)之后,肯定了技术鉴定在审理过程中的重要作用,并以笔者所作两宗实际案例的技术鉴定为例,进行分析和阐述。文章还着意于对“宏观的定性判断”和“微观的定量分析”在技术鉴定中的作用,进行了分析比较,以说明其辩证关系。在此基础上,又指出在对不同格局的碰撞案进行技术鉴定时应掌握的鉴定要领。
After reviewing the two methods of trial of collision cases (litigation and arbitration), this paper affirmed the important role of technical appraisal in the process of trial. Taking the technical appraisal of two actual cases as an example, this paper analyzes and expounds . The article is also intended to analyze and compare the role of “qualitative judgment of macroscopic” and “quantitative analysis of microcosm” in technical appraisal so as to illustrate its dialectical relationship. On this basis, it also points out the appraisal essentials that should be grasped in the technical appraisal of the collision cases of different patterns.
