一国政府对于食品安全的监管职责问题具有深刻的理论意义和实践意义,也是世界各国所必须要研究解决的关乎基本人权的重大问题。本文从政府监管与食品安全两方面分析入手,通过对不同政府机关权力和其职能的分析,指出政府食品安全监管责任的重要落脚点是完善立法与加强执法这两个重要环节。通过对食品安全立法中应该确立的立法宗旨与基本原则的论述,提出了改善我国食品安全监管中政府责任的制度以及措施,从而保证政府在食品安全监管中责任的落实,进而维护食品生产经营和销售的正常秩序,保障广大消费者的生命健康安全。
The government of a country has profound theoretical and practical significance on the regulatory responsibilities of food safety and is also a major issue that all countries in the world must study and solve concerning basic human rights. Based on the analysis of government supervision and food safety, this paper analyzes the power and functions of different government agencies and points out that the important task of government food safety regulation responsibility is to perfect legislation and strengthen law enforcement. By elaborating the legislative purpose and basic principles which should be established in the legislation of food safety, this paper puts forward the system and measures to improve the government responsibility in the supervision of food safety in our country so as to ensure the government’s responsibility in the supervision of food safety, and then safeguard the food production and management and Sales of the normal order to protect the lives of consumers health and safety.
