加入WTO对中国法制进程尤其是中国立法的影响是不言而喻的。所谓“入世”首先是指法律“入世”,是中国国内法与WTO规则及国际惯例的接轨。有的学者把加入WTO以后称为“后立法时代”。在“后立法时代”中国立法将走出传统误区,将由数量规模型立法向质量效益型立法转变,由政府推进型立法向市场主导型立法变迁,由闭门造车型向开放借鉴型立法过渡。在WTO的平台上重估立法的质量和效益,重视法律的修改和完善,将成为“后立法时代”的特色。
The impact of joining the WTO on the legal process in China, especially China’s legislation, is self-evident. The so-called “accession to the WTO” first refers to the fact that the law “joins the WTO” is the alignment of China’s domestic laws with WTO rules and international practices. Some scholars refer to the “post-legislative era” after joining the WTO. In the “post-legislative era”, Chinese legislation will go out of the traditional misunderstanding. It will shift from quantity-scale legislation to quality-benefit legislation, from government-promoted legislation to market-oriented legislative change, and from closed-door vehicles to open-ended legislation. To revalue the quality and effectiveness of legislation on the WTO platform and attach importance to the revision and improvement of laws will become the characteristics of the “post-legislative era.”
