公车改革作为有关政府自觉规范权力运作、寻求先行法治化的一种尝试,其所蕴含的宪政意义和积极因素并不亚于诸多宏观的政治法律体制改革。但是在受到高度评价的同时,这一被政府赋予促进公共善之使命的改革举措也遭遇公众广泛的质疑,基于宪政视域考察所得出的不信任本源集中于程序缺陷引发的若干消极因素。对程序缺陷的矫正成为解惑公众质疑和应对车改系存问题的关键。而程序导向性的矫正措施可以衍生出某种以公众民主参与为特征的更高层次的新型政府决策模式,在一定程度上有助于消弭民主政府与公民不信任的传统冲突。车改本身的积极因素与对其系存的消极因素的矫正机制相结合,折射出政府权力运作迈向宪政格局的曙光。
As a kind of attempt of government to regulate the operation of power consciously and seek the first rule of law, the reform of public bus has no less than the macroscopic reform of political and legal system contained in its constitutional significance and positive factors. However, while being highly appraised, this reform measure, which was given the mission of promoting public good by the government, has also been widely questioned by the public. The source of distrust based on the investigation of constitutional government has focused on a number of negative factors caused by procedural flaws. Rectification of procedural defects has become the key to solving the public questioning and coping with the problems of car reform. The procedural-oriented corrective measures can lead to a higher level of new government decision-making model characterized by public participation in democracy, to a certain extent, help to eliminate the traditional conflict between democratic government and citizens do not trust. The combination of the positive factors of the car reform and the corrective mechanisms of the negative factors that are stored in the car reform reflects the dawn of the government’s power running towards the constitutional pattern.
