2009年2月28日,十一届全国人大常委会第七次会议通过了《中华人民共和国食品安全法》。食品安全法是适应新形势发展的需要,从法律制度上解决现实生活中存在的食品安全问题,保证食品安全而制定的,其中确立了以食品安全风险检测和评估为基础的科学管理制度,明确食品安全风险评估结果作为制定、修订食品安全标准和对食品安全实施监督管理的科学依据。但其中关于食品安全监管的内容无论是在理论上还是在具体实施上都存在一些问题,这些问题引发了对食品安全监管制度的思考。
