投资者-东道国争端解决机制是国际投资仲裁领域的重点问题,也是中欧BIT谈判的关键点之一。ISDS机制在双边投资协定的设计将对我国以后的自贸协定和投资协定中的ISDS的利用产生影响,同时也关系到我国对国际经贸新规则制定的参与问题,因此应当引起重视。本文以对中欧BIT谈判中的ISDS问题的分析为基础,试图提出中国对该问题的应对之策。
The investor-host country dispute settlement mechanism is a key issue in the field of international investment arbitration and is also one of the key points in the BIT negotiations between China and the EU. The design of Bilateral Investment Agreements (ISIs) will have an impact on the future use of ISDS in China’s FTAs and investment agreements. At the same time, it will also affect China’s participation in the formulation of new international economic and trade rules. Therefore, it deserves our attention. Based on the analysis of the ISDS issue in the Sino-EU BIT negotiations, this article attempts to propose China’s response to the issue.
