元朝初年,官吏无俸无禄无公田,吏治腐败。后随着养廉制度的完善,法律当中有关赃罪法的规定也渐成体系,遂使奖善与罚恶同行共举。元朝人徐元瑞(字君祥),曾在元成宗大德五年(1301)撰成《习吏幼学指南》(简称《吏学指南》)一书。该书为了使习吏之人掌握律书要旨,因而摘取当时官场中通用的法律术语及其古代用法,给予详细诠释。这对研究元代法律术语的概念及法律制度
