获得合理的工资是船员的根本权利,船员工资水平对船员数量的维持、船员素质的提升以及我国航海业的发展至关重要。我国法律法规对船员最低工资标准的设立程序以及船员最低工资制度的保障等问题均没有明确规定,不利于船员队伍的发展。只有通过研究探讨目前我国船员最低工资制度存在的瑕疵,才能完善相关法律法规,更好地保障船员权益,实现以船员大国的姿态切实履行2016年对我国生效的《海事劳工公约》,促进船员队伍的健康发展。
To obtain a reasonable salary is the fundamental rights of the crew. It is of utmost importance for the crew’s wages to maintain the number of sailors, enhance the quality of crew and the development of China’s maritime industry. The laws and regulations of our country have not clearly stipulated the procedures for establishing the minimum wage for seafarers and the guarantee of the minimum wage for seafarers, which is not conducive to the development of the crew. Only by studying the flaws in the current minimum wage system for sailors in China can the relevant laws and regulations be improved and the rights and interests of seafarers better protected so as to effectively implement the “Maritime Labor Convention” in force for China in 2016 with the attitude of a large seafarer and promote the work of the crew The healthy development.
