万事万物之运行皆有其规律,人之行为亦不例外。行为惯性为人之行为的客观规律。从形式上讲,人之行为倾向于有序化;从理性上讲,人之行为倾向于增加福利。司法审判以“公正”为最高价值取向和实现目标。法官是理性的化身,陪审团是经验的代表,司法独立和审判公开原则源自于行为惯性规律的客观要求。成文法、判例和习惯均为行为惯性规律的客观反映。法官适用法律时应遵循“法不溯及既往”,“遵循先例”,“法无明文规定时依习惯裁判民事纠纷”等基本原则。
All things run their own laws, human behavior is no exception. The law of inertia is the objective law of human behavior. Formally, human behavior tends to be orderly; in a rational sense, human behavior tends to increase welfare. Judicial judgment takes “fairness” as its highest value and achieves its goal. Judges are rational incarnations, juries are representatives of experience, judiciary independence and the principle of open trial come from the objective requirements of behavioral inertia. Statutory law, precedent and habit are the objective reflection of the law of inertia of behavior. Judges should follow the basic principles of “law does not retroactively”, “follow the precedent”, “civil disputes according to customary arbitration when there is no express provision of the law” when the judge applies the law.
