外商投资企业与高等教育国际化两者之间存在着经济与行政、全球化与本土化、法律与政策等多方面的相似因素的交织。为此,应总结外商投资法律制度在适用过程中的经验教训,反思高等教育国际化相关法律法规存在的问题,并借鉴外商投资法律制度发展过程中之成熟经验,提出高等教育国际化相应法律之完善建议,即构建专门调整高等教育国际化的法律;高等教育法律法规之间合理衔接;高等教育国际化发展避免地方无序化的法律控制。 There are many similarities between the foreign-invested enterprises and the internationalization of higher education that exist between economy and administration, globalization and localization, and laws and policies. To this end, we should sum up the experiences and lessons of the legal system of foreign investment in the application process, reflect on the problems existing in the laws and regulations related to the internationalization of higher education, and draw on the mature experience in the development of the legal system of foreign investment and put forward corresponding laws on the internationalization of higher education Improve the proposal, that is, to construct a law that specifically regulates the internationalization of higher education; reasonably link up the laws and regulations of higher education; and promote the internationalization of higher education so as to avoid the legal control over the disorder of the place.
