建立电信市场的有效竞争已成为各国电信改革的共识。电信行业的发展不能仅靠市场的作用力,有效的监管是电信业健康快速发展的重要保证。基于电信行业的特殊性,非对称管制模式已成为电信监管的必然选择。本文在分析我国现阶段电信市场发展的基础上,针对我国电信业非对称管制实施的现状,在我国第一部电信法即将出台之际,提出了一些有关非对称管制制度的立法建议。
Effective competition in the establishment of the telecommunications market has become the consensus of all countries in telecommunications reform. The development of the telecommunications industry can not rely solely on the market forces. Effective regulation is an important guarantee for the healthy and rapid development of the telecommunications industry. Based on the particularity of the telecom industry, the non-symmetrical control mode has become the inevitable choice for telecom regulation. Based on the analysis of the development of telecom market in our country at present stage, aiming at the status quo of asymmetric control in telecom industry in our country, this article puts forward some legislative suggestions on asymmetric control system when the first telecom law in our country is introduced.
