随着科技的不断进步与发展,科学技术在诉讼过程中的运用越来越广泛,发挥的作用也逐渐增大。司法鉴定是否科学、严密,直接关系到所涉案件的审判质量及社会效果。物证鉴定意见不具有既定的证明力,对其证明力的评判发挥着关键性作用,但其证明力的影响因素是多方面因素的,包括其可靠性、意见的类型及质证程度等等。因此,物证鉴定意见证明力的判断,需要从多个角度,多个方面进行综合考量,以确定不同影响因素对证明力的影响。
With the continuous progress and development of science and technology, science and technology have become more and more widely used in the process of litigation, and the role played by them has also been gradually increasing. Whether the forensic science is scientific and rigorous is directly related to the quality of trials and the social effects of the cases involved. The physical evidence appraisal opinion does not have the established proving power, and plays a key role in the evaluation of its testimony power. However, the influencing factors of its testimony power are various factors, including its reliability, the type of opinion and the degree of quality of evidence. Therefore, the judgment of the evidence identification of evidence requires comprehensive consideration from multiple perspectives and aspects to determine the influence of different factors on the proof power.
