现代社会科技飞速发展的同时,生态恶化、资源匮乏成为全球瞩目的问题。德国社会学家乌尔里希·贝克首先提出了风险社会的理论。该理论的提出促使风险刑法理论的产生,但是不可否认的是该理论仍然存在很多的缺陷。自由作为法律的基本价值之一,一方面,自由应当得到尊重,另一方面,风险刑法理论对自由的基本价值却形成了巨大的冲击。本文旨在分析风险刑法对自由价值的腐蚀,提出一些风险社会的因应之策。
At the same time of rapid development of modern social science and technology, ecological deterioration and lack of resources have become the global issues of concern. Ulrich Beck, a German sociologist, first put forward the theory of risk society. The theory put forward to promote the theory of risk criminal law, but it is undeniable that the theory still has many defects. On the one hand, freedom should be respected as one of the basic values of law. On the other hand, the theory of risk criminal law has had a huge impact on the basic value of freedom. The purpose of this paper is to analyze the corrosiveness of the risk criminal law on the free value and to propose some solutions to the risk society.
