目前,国务院已基本上肯定了铁道部提出的在全路实行“网运分离”的改革方案。这标志着我国铁路运输管理体制改革的总体走向已经明确,铁路改革将进入一个在总体部署下系统推进体制转换和结构调整的新阶段。基于此,结合我国的国情和路情,按市场经济发展的要求,认真做好铁路改革的立法规划,加紧研究制定与铁路改革相配套的运输政策和法律法规显得尤为迫切和重要。 针对我国铁路即将按“网运分离”实施的重组改革,笔者认为,必须在以下几方面加紧做好立法规划,提出国铁改革重组的一系列议案,制定、修改和完善相应的法律、法规。
At present, the State Council has basically affirmed the reform proposal put forward by the Ministry of Railways for “separation of transportation from operation of the network and transportation” throughout the road. This shows that the general trend of the railway transport management system reform in our country has been made clear. The railway reform will enter a new phase of systematically promoting the system transformation and structural adjustment under the overall arrangement. Based on this, taking into consideration China’s national conditions and road conditions, according to the requirements of the development of the market economy, it is imperative and urgent to conscientiously do a good job in the legislative planning of the railway reform and step up study and formulation of transport policies and laws and regulations that are compatible with the railway reform. In view of the reorganization and reform to be implemented by our country on the separation of transportation and operation of the railway, the author believes that we must step up legislation planning in the following aspects and put forward a series of proposals on the reform and reorganization of the state-owned railways to formulate, amend and improve the corresponding laws and regulations.
