指出著作权利益补偿是解决网络信息资源共享与著作权保护之间矛盾问题的有效途径。通过分析网络信息资源著作权利益补偿主体之间的关系,构建网络信息资源著作权利益补偿的运行机理与交易流程,重点围绕著作权人与网络服务提供者的利益补偿关系,建立著作权人与网络服务提供者利益补偿的委托代理模型,并提出网络信息资源著作权利益补偿机制的实现要素。
It is pointed out that the compensation of copyright interest is an effective way to solve the contradiction between the sharing of network information resources and the protection of copyright. By analyzing the relationship between the subjects of copyright compensation of network information resources, this paper constructs the operation mechanism and transaction flow of copyright compensation of network information resources, focusing on the compensation relationship between the copyright owners and the network service providers, and establishes the relationship between copyright owners and network service providers Principal-agent model of compensation for profits, and puts forward the realization of the compensation mechanism of copyright of network information resources.
