产品责任的归责原则不断随经济发展实现现代化演变,同时在我国面临着“怎么办”即怎样建立合理的产品责任归责原则的问题。本文将其上升到方法论的角度分析,把法律经济学作为分析进路,以卡拉布雷西的侵权评估框架为基础、构建理论模型、利用成本收益分析法来对其现代化进程进行研究,并提出以严格责任原则为主、改进(创新)领域实行过错责任原则的现代化趋势的观点。
The responsibility principle of product liability is constantly evolving with the development of economy. At the same time, it faces the problem of how to establish a reasonable product liability principle in our country. This article takes it up to the point of view of methodology, takes legal economics as the analysis approach, constructs the theoretical model based on Calabresi’s framework of infringement assessment, and uses cost-benefit analysis method to study its modernization process.
