我国现行的夫妻财产制是由2001年新婚姻法确立的,是法定财产制与约定财产制相结合的夫妻财产制。这种立法制度适应了生产力的发展,有相当进步,但也存在一些缺憾。本文对现行夫妻财产制进行了评价并对其完善提出了建议。
The current system of conjugal property in our country was established by the new marriage law in 2001. It is a system of conjugal property in which statutory property system and agreed property system are combined. This legislative system adapted to the development of productive forces has made considerable progress, but there are also some shortcomings. This article evaluates the current property system of husband and wife and puts forward some suggestions to improve it.
