“垃圾围城”是我国城市化进程中难以绕过的难题,同时更难化解的是市民对待这一问题的环保伦理困境。面对日益增长的垃圾存量,必须寻求填埋以外的解决方式,即减量化、分类回收以及焚烧发电的方式。这就依赖于市民消费伦理的改变,以及承担起分类投放垃圾的社会责任。这一责任首先表现为伦理义务,但也有必要在某些方面转化为法律义务。于是,我们有必要对当前垃圾治理的伦理困境进行反思,在此基础上,探求法治的回应机制。
“Junk Besieged City” is a difficult problem to be circumvented in the process of urbanization in our country. At the same time, it is harder for the public to solve the environmental ethical dilemma of treating this issue. In the face of growing stockpiles of waste, solutions other than landfill must be sought, namely reductions, separate recycling and ways to incinerate electricity. This depends on changes in the ethics of consumer spending, as well as the social responsibility of sorting out trash. This responsibility first manifests itself as an ethical obligation, but it is also necessary to translate it into a legal obligation in some respects. Therefore, it is necessary for us to reflect on the current ethical dilemma of waste management, and on this basis, to explore the response mechanism of the rule of law.
