我国司法机关依法独立行使职权,不受任何机关、团体和个人干涉,但司法独立不得独立于党的领导,应同党的政治原则保持一致。司法独立原则在我国的实施现状并不理想,司法权的地方化,司法权与传统习惯和文化的碰撞等很多问题也充分说明了司法独立的不足,改革司法人事财政体制,实现司法权的中央化,借鉴国外的法律文化,这些措施为我们建设有中国特色的司法独立制度,都将具有相当重要的作用。
The judiciary in our country independently exercises its powers in accordance with the law and is free from any interference by any organ, organization or individual. However, the independence of the judiciary must not be independent of the party’s leadership and should be consistent with the political principles of the party. The status quo of judicial independence in our country is not ideal. Many issues such as the localization of judicial power, the collisions between judicial power and traditional customs and culture fully illustrate the inadequacy of judicial independence, reform the financial system of judicial personnel and realize the central authority of judicial power And learn from the legal culture of other countries. These measures will have an important role in building an independent judiciary system with Chinese characteristics for us.
