“旧城”界定不清、征收程序不规范导致我国旧城改造中征收矛盾日渐尖锐。美国法上的衰败区征收与旧城改造中的征收极为相似,两者都是通过征收权的行使,借助私人开发商的力量,清除城市衰败地区,实现城市复兴。不同之处在于,衰败区征收始终关注公共利益问题,注重通过明确“衰败”内涵、规范征收程序、协调清除衰败与商业开发之间的关系来保证系争征收的公共利益性质,从而在一定程度上缓和了征收权与财产权之间的张力。通过梳理衰败区征收的发展演变,以期对旧城改造中征收问题的解决有所启示。
